Foreign Qualification

A foreign qualification is required by an entity organized in the domestic state to conduct business in another state of the USA.

A foreign qualification is required by a US entity when it has a ‘physical presence’ in the State where it is not registered with the secretary of that State.

 

The physical presence is determined if an entity is conducting the business of some type. The foreign entity has to collect sales and use tax in any State it has the physical presence.

 

A foreign qualification requires an entity to register with that State, hire an agent and get necessary licenses for tax purposes.
